Terms of Service

These Terms of Service ("Terms") are a binding legal agreement between you and TripCatholic ("TripCatholic," "we," "our," or "us") that governs your use of the TripCatholic mobile application, our website at www.tripcatholic.com, the TripCatholic Plus subscription, and any related services we provide (collectively, the "Services").

Please read these Terms carefully. They contain important provisions, including a disclaimer of warranties, a limitation of our liability, an indemnity obligation, and a requirement that disputes be resolved by binding individual arbitration and not in court (see Sections 16 and 17). By creating an account or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and Account Registration

1.1 Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to create an account. By using the Services you represent that you meet this requirement, that you are legally able to enter into a binding contract with TripCatholic, and that you are not barred from using the Services under the laws of the United States or any other applicable jurisdiction.

1.2 Account

To access most features you must create an account using email and password, Sign in with Apple, or Sign in with Google. You agree to provide accurate and complete information when you register and to keep it up to date. You are responsible for keeping your account credentials confidential and for everything that happens under your account. Notify us at team@tripcatholic.com promptly if you believe your account has been used without your permission.

You may not create an account on behalf of another person without authorization, create more than one account for yourself, transfer your account to another person, or share your account credentials.

2. License to Use the Services

Subject to your continued compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial use, and, if applicable, to download and install one copy of the mobile app on a device that you own or control, solely to use the Services in accordance with these Terms and the applicable app-store terms.

3. TripCatholic Plus Subscription

3.1 What TripCatholic Plus Includes

TripCatholic Plus is our paid subscription that unlocks premium features described in the app. The specific features included in TripCatholic Plus may change from time to time as we add, modify, or remove features.

3.2 Billing and Auto-Renewal

TripCatholic Plus subscriptions are sold through the Apple App Store or Google Play Store and managed by our subscription technology partner, RevenueCat. **Payment will be charged to your Apple ID or Google account at confirmation of purchase.** Subscriptions **automatically renew** for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

3.3 Free Trial

If we offer a free trial, your subscription will automatically convert to a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. Eligibility for free trials may be limited and we reserve the right to modify or discontinue free trials at any time.

3.4 Managing and Canceling

You can manage or cancel your subscription at any time in your device's subscription settings (Apple ID Subscriptions on iOS; Google Play Subscriptions on Android). Canceling will stop future renewals but will not refund the current period. After cancellation, your TripCatholic Plus access will continue until the end of the current paid period and then revert to the free tier.

3.5 Refunds

All purchases are final and non-refundable except where required by law. Refund requests are governed by the policies of Apple or Google, as applicable, and must be submitted to them directly. We do not process refunds for app-store purchases.

3.6 Price Changes

We may change subscription prices at any time. Price changes that affect existing subscribers will be communicated to you in advance through the app, by email, or as required by Apple's or Google's policies, and will not apply until your next renewal. If you do not agree to a price change you may cancel before the new price takes effect.

4. User Content

4.1 What "User Content" Means

"User Content" means anything you submit to or through the Services, including community posts and replies, ratings, tips, comments, reports, trip names and descriptions, trip activity notes, profile information, profile photos, trip cover photos, photographs of places, and any other text, image, or material you upload.

4.2 Your Ownership

You retain all ownership rights you already have in your User Content. Nothing in these Terms transfers your ownership to us.

4.3 License You Grant Us

By submitting User Content, you grant TripCatholic a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable license to host, store, reproduce, modify (for example, to format, resize, or create thumbnails), adapt, publish, translate, distribute, publicly perform, publicly display, and create derivative works of your User Content in connection with operating, providing, and promoting the Services and our business. This license continues for as long as your User Content remains on the Services and for a reasonable period thereafter to allow us to remove copies from active systems and from backups in the ordinary course. Your license to us for any User Content you have shared with other users (for example, through a public trip or a community post that others have viewed, replied to, or relied on) continues even after you delete the underlying content from your account, solely to the extent necessary to leave intact other users' permitted uses.

You also grant each other user of the Services a non-exclusive license to access and use your publicly shared User Content as permitted through the functionality of the Services.

4.4 Your Representations and Warranties

By submitting User Content you represent and warrant that:

- you own the User Content, or you have all rights, licenses, consents, and permissions necessary to grant us the rights described in Section 4.3;
- your User Content does not and will not infringe, misappropriate, or violate any third-party intellectual property right, right of publicity or privacy, contractual right, or other right;
- if your User Content includes a person, you have obtained the necessary releases from that person (or, if the person is a minor, from their parent or legal guardian) to permit the uses contemplated by these Terms;
- if your User Content includes a place that requires permission to photograph, distribute, or publish (for example, certain churches, museums, or private property), you have obtained any required permission; and
- your User Content complies with these Terms and all applicable laws.

4.5 Photographs of Sites

If the Services now or in the future allow you to upload photographs of churches, basilicas, shrines, monasteries, museums, or other religious or cultural sites, you specifically agree that:

- you took the photograph yourself, or you hold a written license from the photographer that permits the uses contemplated by these Terms;
- you have complied with any photography rules posted at the site or imposed by the site's custodian, and you have obtained any required permission to publish the photograph;
- any recognizable persons depicted in the photograph have consented to publication;
- you will not upload photographs that depict the faithful at private moments of devotion (such as confession or reception of Communion) in a way that identifies them without their consent;
- you will not upload photographs of relics, sacred art, archaeological items, or museum collections where photography or publication is prohibited; and
- you will properly attribute and respect any third-party rights (including those of the photographer, the site, or the diocese), and you will respond to any request from a rights-holder by promptly removing the content or providing additional information to us.

We may, at our sole discretion, watermark, attribute, geotag, or otherwise label photographs you upload to associate them with the site or city to which they relate.

4.6 Our Right to Moderate

We have no obligation to monitor User Content, but we may review, screen, edit, filter, refuse, remove, restrict, or take any other action with respect to any User Content at any time, for any reason or no reason, including if we believe that the User Content violates these Terms, infringes a third party's rights, or otherwise creates risk for TripCatholic, our users, or the public. We are not responsible for User Content and we do not endorse any opinions expressed by users.

4.7 Reporting

If you encounter User Content that you believe violates these Terms, please report it using the in-app reporting feature or email us at team@tripcatholic.com.

5. Acceptable Use

You agree not to, and not to attempt to:

- use the Services to violate any law, regulation, or third-party right;
- post or transmit content that is unlawful, fraudulent, defamatory, libelous, obscene, pornographic, hateful, harassing, threatening, abusive, invasive of another's privacy, or designed to incite violence or self-harm;
- impersonate any person or entity, misrepresent your affiliation with any person or entity, or use a misleading display name or avatar;
- post content that promotes discrimination, bigotry, racism, or hatred against any individual or group, including on the basis of religion;
- post commercial advertising, spam, unsolicited promotional material, chain letters, pyramid schemes, or content that operates as a competing service;
- collect, harvest, or scrape information about other users without their consent or our permission;
- use the Services to track, identify, surveil, or stalk any individual;
- upload viruses, worms, malware, ransomware, or any other malicious code or technology;
- probe, scan, or test the vulnerability of the Services or breach any security or authentication measure;
- interfere with, disrupt, overload, or impair the Services or the servers or networks that host them;
- access the Services through automated means (including bots, scrapers, or crawlers) or use the Services to build or train any machine-learning model or large language model, or to compile a dataset for the benefit of any third party;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying ideas of the Services, except to the extent applicable law expressly permits and the restriction cannot be waived by contract;
- copy, modify, distribute, sell, rent, lease, sublicense, or create derivative works of any part of the Services or our content (including site descriptions, histories, guides, itineraries, photographs, illustrations, and the rose-window mark), other than your own User Content;
- frame or mirror any part of the Services or use any meta tags or other hidden text using our trademarks without our prior written permission;
- remove, alter, or obscure any copyright, trademark, or other proprietary-rights notice;
- circumvent, disable, or interfere with any feature that protects, restricts access to, or otherwise enforces limitations on the Services (including the paywall for TripCatholic Plus); or
- use the Services in any way that could damage, disable, overburden, or impair them, or interfere with any other user's enjoyment of them.

6. Intellectual Property

The Services, including the TripCatholic name, logo, rose-window mark, site descriptions, histories, guides, itineraries, illustrations, software code, look and feel, organization, and arrangement of content (other than User Content), are owned by TripCatholic or our licensors and are protected by United States and international copyright, trademark, trade dress, patent, and other intellectual-property laws. Except for the limited license granted in Section 2, no rights are granted to you by implication, estoppel, or otherwise.

Trademarks of third parties identified on the Services (for example, the names of religious orders, cities, or institutions) are the property of their respective owners and their appearance on the Services does not imply any affiliation with, endorsement by, or sponsorship of TripCatholic by those owners.

7. Copyright Complaints (DMCA)

We respect intellectual-property rights and respond to clear notices of alleged copyright infringement in accordance with the United States Digital Millennium Copyright Act ("DMCA"). If you believe content on the Services infringes a copyright you own or control, please send a notice with the following information to our designated copyright agent:

1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.

2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of those works.

3. Identification of the material claimed to be infringing and information reasonably sufficient to allow us to locate it (for example, the URL or in-app screen and a description of the specific item).

4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.

5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

We may remove or disable access to material that is the subject of a notice that substantially complies with the requirements above, and we may forward the notice (including your contact information) to the user who submitted the material.

Counter-Notification

If you believe your material was removed in error, you may send a counter-notification to the address above containing:

1. Your physical or electronic signature.

2. Identification of the material that was removed and the location at which it appeared before it was removed.

3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.

4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if your address is outside the United States, the United States District Court for any judicial district in which TripCatholic may be found) and that you will accept service of process from the person who provided the original notice or an agent of that person.

If we receive a valid counter-notification, we may restore the removed material unless the original complaining party files an action seeking a court order against you within ten (10) business days.

Repeat Infringers

We will, in appropriate circumstances and at our discretion, disable or terminate the accounts of users who are repeat infringers of copyright.

8. Third-Party Services and Content

The Services include or rely on third-party services and content, including Mapbox maps, Google Maps tiles and Street View imagery, Unsplash photography, and content sourced from publicly available materials about Catholic sites, saints, and history. These third-party services and content are provided by their respective owners and are subject to those owners' terms. We do not control and are not responsible for third-party services or content and we do not warrant their accuracy, completeness, or suitability for any purpose.

When you tap a link or button that takes you off the Services (for example, to get walking directions from your device's map application or to view a third-party booking site), the third party's terms and privacy policy will govern your interaction with that third party.

9. Accuracy of Information; Practical Guidance

We do our best to keep information about Catholic sites, mass times, opening hours, events, and historical narratives accurate, but the Services are provided for informational purposes only. Some information is editorially curated, some is researched from publicly available sources, some is generated or summarized with the assistance of automated tools (including artificial-intelligence tools), and some is submitted by other users. We do not guarantee the accuracy, completeness, currency, or reliability of any information on the Services. Before traveling, visiting a site, attending a liturgy, or making any plan based on information you find in the Services, you should verify the information directly with the site, the parish, the diocese, an official tourism resource, or another reliable source. TripCatholic is not responsible for any loss, harm, missed event, or other consequence that results from your reliance on information in the Services.

10. Trips, Sharing, and Collaboration

The Services let you create trips, invite collaborators, and generate shareable links to your trips. Anyone with a share link can access the trip at the role you assigned (viewer or editor). You are responsible for the people you invite and for the links you share. We are not responsible for what collaborators or recipients do with the information you provide to them.

11. Community Profile Visibility

Your display name and avatar are shown to other users only when you take an action that involves them:

Community contributions. When you post a tip, comment, or reply on a site page, your display name and avatar appear alongside that contribution and are visible to other users of the Services. Other users cannot open a separate profile page about you or view your other activity from a contribution — they see only your display name and avatar on the post itself.

Shared trips. When you join a trip as a collaborator or are added to a shared trip, the other members of that trip can see that you are a member, along with your display name and avatar. As with community contributions, this does not give other members access to a separate profile page or to your activity elsewhere in the Services.

We do not currently offer a public profile page that others can browse, and we do not display your saved sites, visited sites, or trip history to other users. You control this exposure by choosing whether to post publicly and whether to join or share a trip. You can edit your display name and avatar at any time in Settings.

12. Feedback

If you send us feedback, suggestions, ideas, feature requests, or recommendations about the Services ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, and transferable license to use the Feedback for any purpose without any obligation to you. Feedback is not confidential.

13. Termination

You may stop using the Services at any time. You may delete your account by following the in-app deletion flow or by emailing team@tripcatholic.com.

We may suspend, restrict, or terminate your access to all or part of the Services at any time, with or without notice, and with or without cause, including if we reasonably believe you have violated these Terms, your use creates risk for TripCatholic or other users, your use is fraudulent or unlawful, or operation of the Services has become impractical for technical, legal, or commercial reasons.

Upon termination, your right to use the Services will end immediately. Any provisions of these Terms that by their nature should survive termination — including Sections 4 (User Content), 5 (Acceptable Use), 6 (Intellectual Property), 7 (DMCA), 9 (Accuracy), 12 (Feedback), 14 (Disclaimers), 15 (Limitation of Liability), 16 (Indemnification), 17 (Dispute Resolution), and 18 (General) — will survive.

14. Disclaimers

THE SERVICES, INCLUDING ALL CONTENT, FEATURES, AND FUNCTIONALITY, ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, TRIPCATHOLIC AND OUR LICENSORS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES, OR ANY CONTENT OR INFORMATION ON THEM, ARE ACCURATE, RELIABLE, COMPLETE, OR CURRENT.

YOU USE THE SERVICES AT YOUR OWN RISK. ANY DECISION YOU MAKE BASED ON INFORMATION FROM THE SERVICES — INCLUDING DECISIONS ABOUT TRAVEL, SAFETY, RELIGIOUS PRACTICE, OR FINANCIAL EXPENDITURE — IS YOUR SOLE RESPONSIBILITY.

Some jurisdictions do not allow the exclusion of certain warranties. To the extent we are prohibited from disclaiming such warranties, our liability for breach of any such warranty is limited to the maximum extent permitted by law.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TRIPCATHOLIC, ITS AFFILIATES, OR OUR OR THEIR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TRIPCATHOLIC FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE LIMITATIONS ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, FRAUDULENT MISREPRESENTATION, DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW.

16. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless TripCatholic and its affiliates, and our and their directors, officers, employees, agents, and licensors, from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your User Content; (b) your use of or access to the Services; (c) your violation of these Terms; (d) your violation of any third-party right, including intellectual-property, publicity, or privacy rights; or (e) your violation of any applicable law. We reserve the right to assume the exclusive defense and control of any matter for which you are required to indemnify us, in which case you will cooperate with us in asserting any available defenses.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

17.2 Informal Resolution First

Before filing a claim against TripCatholic, you agree to try to resolve the dispute informally by emailing team@tripcatholic.com with a brief description of the dispute and your contact information. We will try to resolve the dispute informally within sixty (60) days. If we cannot, either party may proceed with the formal dispute-resolution process below.

17.3 Binding Individual Arbitration

You and TripCatholic agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (a "Dispute") will be resolved by final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, and not by a court, except as set out in Sections 17.5 and 17.6. The arbitration will be conducted in English by a single arbitrator. The seat of arbitration will be Columbus, Ohio, although you may elect to participate by telephone or video conference, or if your claim is for less than USD $10,000, on the basis of written submissions alone. The arbitrator's award will be binding and may be entered as a judgment in any court of competent jurisdiction.

17.4 Class-Action Waiver

You and TripCatholic agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, representative, or private-attorney-general action. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative or class proceeding.

17.5 Small-Claims Court

Notwithstanding Section 17.3, either party may bring an individual action in small-claims court for disputes within the scope of that court's jurisdiction.

17.6 Injunctive Relief; Intellectual Property

Either party may bring an action in a court of competent jurisdiction solely for injunctive relief to stop unauthorized use or abuse of the Services or infringement of intellectual-property rights, without first engaging in arbitration or the informal resolution process described above.

17.7 30-Day Right to Opt Out

You can opt out of Sections 17.3 and 17.4 by emailing team@tripcatholic.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Your opt-out notice must include your name, the email address associated with your account, and a clear statement that you do not wish to resolve disputes through arbitration. Opting out will not affect any other provision of these Terms.

17.8 Exception for EU and UK Consumers

If you are a consumer resident in the European Union, the European Economic Area, the United Kingdom, or another jurisdiction whose mandatory consumer-protection laws restrict the enforceability of arbitration or class-action waivers, the arbitration and class-action provisions in this Section 17 do not apply to you to the extent they conflict with the mandatory laws of your jurisdiction, and you may bring claims in the courts of your country of residence. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

18. Changes to the Services and to These Terms

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable to you or to any third party for any modification, suspension, or discontinuation.

We may also update these Terms from time to time. If we make a material change, we will provide reasonable notice — for example, by email, by a notice in the app, or by updating the "Effective Date" at the top of these Terms and prompting you to review them. Your continued use of the Services after the effective date of an updated version constitutes your acceptance of the changes. If you do not agree to the changes, you must stop using the Services.

19. Apple App Store and Google Play Provisions

The following additional terms apply when you download the TripCatholic app from the Apple App Store:

- These Terms are between you and TripCatholic only, not with Apple. Apple is not responsible for the app or its contents.
- Your license to use the app is limited to a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide any maintenance and support services with respect to the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price you paid for the app (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims by you or any third party relating to the app, including product-liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, or claims under consumer-protection or similar legislation.
- Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the app or your use of it infringes that third party's intellectual-property rights.
- You represent that (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist-supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

If you download the app from the Google Play Store, you acknowledge that your use is also subject to the Google Play Terms of Service.

20. General

20.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies we reference or post in the Services, constitute the entire agreement between you and TripCatholic regarding the Services and supersede all prior or contemporaneous agreements, communications, and proposals.

20.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.

20.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

20.4 Assignment
